Property Standards

The City of Timmins By-law No. 2007-6489 provides minimum maintenance standards for the physical condition and for the occupancy of all property in the City of Timmins. All property owners are required to maintain and repair their property, including rental properties, to protect the health and safety of residents and visitors.

The Property Standard by-law is most often used for properties with multiple concerns, which can include both interior and exterior inspections. Interior inspections are complaints filed by tenants who allow access to the Enforcement Officer into the dwelling to conduct an inspection. Exterior inspections do not require an invitation onto private property as per the Building Code Act. 

The most common use of this by-law is to issue legal order for large yard clean-ups and demolition of buildings that are in extreme disrepair and/or structurally unsound.

Complaints about property standard violation can be submitted to Service Timmins by phone 705-264-1331 or online at service.timmins.ca. Enforcement Officers will review and validate the complaint and take further action to investigate and take enforcement actions if necessary.

If a property owner does not comply with the Property Standards By-law, they may be issued an Order Requiring Compliance. Failure to comply with the Order could result in the municipality taking action as per the Building Code Act, Section 15 4, to bring the property into compliance. Notice of costs incurred by the municipality to perform any work required to bring the property into compliance, including applicable administration fees, may be registered against the owner's land and/or may be recovered as municipal taxes. 

Cleaning and Clearing Land

The City of Timmins By-law No. 2008-6599 provides for the draining, cleaning, and clearing of land, including the clearing of refuse to protect the health and safety of residents and visitors. All property owners are required to keep their land, including rental properties, clean, cleared and free of garbage and litter.

The Cleaning and Clearing Land by-law is most often used for smaller yard clean-ups that require quick attention. This by-law does not have an appeal process, which allows clean-ups to be accomplished two-weeks earlier than Property Standard infractions.

If a property owner does not comply with the Cleaning and Clearing Land By-law may be found guilty of an offence and is liable to any penalty as provided in the Provincial Offences Act.
