WHEREAS pursuant to City of Timmins By-Law No. 2023-8855 which sets out policies and procedures for the sale and disposition of municipal land.
AND WHEREAS Section 6.0 – Accountability, Transparency and Public Notice Requirements, requires that in considering a sale of City owned land, the land must be declared surplus to the needs and requirements of the municipality and prior to the land sale, notice of the disposition of the surplus lands posted on the City’s website and advertised in the local newspaper for two consecutive weeks. The purpose of such notice is to secure any comments from the public respecting this proposed land sale to be considered by Council so that Council may consider, and if applicable, incorporate into an implementing by-law.
AND WHEREAS the Council for the Corporation of the City of Timmins considers it desirable and expedient that the described land, identified as Plan 6R-9530, Parts 1 and 2 (part of Roll No. 5627-050-056-01000) surplus to the needs of the municipality and sell the subject lands to the adjacent property owners (Purchasers) on Commercial Avenue subject to certain conditions and costs, as below:

- That the subject land shall be sold for the values indicated above plus HST;
- This value is based on the appraised value, and includes the appraisal fee of $1,100.00 plus HST, and a reference plan fee of $1,600.00 plus HST for each property;That the legal fees for the Municipality and Purchasers shall be paid for by the Purchasers;
- That the Ontario Northland Transportation Commission (ONTC) conditions, restrictions and covenants, which states that the City of Timmins shall not transfer the subject lands to any third party without the consent of the ONTC, shall be lifted prior to final transfer;
- That the Purchasers acknowledge the existing Hydro One easement on the subject land;
- That each of the Purchasers shall consolidate the subject land with the adjacent properties on Commercial Avenue to form one property; and
- That this direct land sale be approved by Council by-law.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the City of Timmins does hereby declare the following described land as being surplus to the Corporation’s requirements.

Letters of support or concern with regard to this land sale will be received by the undersigned up until Thursday, May 1, 2025, 4:00 p.m. and will be presented for Council’s consideration.
